In this Act, unless otherwise stated or the context otherwise requires—
Appeal Board

chief executive officer

civil service

means the service of the State in any capacity, but does not include service in—

  • (a)an office as a Judge;
  • (b)a judicial office that is the responsibility of the Judicial Services Commission;
  • (c)an office in the Republic of Fiji Military Forces;
  • (d)the office of a member of a commission, tribunal or board established by, or continued in existence under the Constitution.
  • (e)a statutory authority; or
  • (f)a government company;

Civil Service Code of Conduct

means the rules in section 6;

civil service union

means a trade union that is registered under Part 4 of the Employment Relation Act 2007 and recognised by the Commission for the purpose of collective bargaining in relation to a group of employees;

Civil Service Values

means the values set out in section 4;

Commission

means the Public Service Commission continued under section 125 of the Constitution;

Constitution

means the Constitution of the Republic of Fiji;

constitutional functions

Constitutional Offices Commission

delegate

delegation

department

has the same meaning as in the Financial Management Act 2004;

means a person employed in the civil service but does not include a wage earner;

Judicial Service Commission

Judicial Services Commission

means the Judicial Services Commission continued under section 104 of the Constitution;

member

Minister

means the Minister responsible for the civil service;

Minister for Finance

means the Minister to whom responsibility for finance or public finance is for the time being assigned;

Ministry

means the Ministry of Civil Service;

Ownership Minister

parliamentary body

has the same meaning as in the Financial Management Act 2004;

permanent secretary

means a person appointed in accordance with section 127 of the Constitution;

Public Service Commission

subordinate legislation

means any instrument of a legislative character made in exercise of a power conferred by an Act, and includes directions;

this Act

includes any regulations or directions made under it; and

wage earner

means a person employed in the civil service by reference to a rate of remuneration or payment other than an annual one.
