(1) A person shall not use for trade an area measuring instrument and an area measuring instrument is not in accordance with the requirements of this Act unless—
  • (a)the instrument is of an approved pattern;
  • (b)the instrument is in accordance with the Fiji Design and Performance Specifications as they relate to area measuring instruments;
  • (c)the instrument does not exceed the maximum permissible error for area measuring instruments;
  • (d)the adjusting mechanism of the instrument is suitably secured and stamped so that such mechanism cannot be readily tampered with;
  • (e)all indicating pins or sensors are operating;
  • (f)the instrument is marked legibly and indelibly with the maximum area of material it is approved to measure; and
  • (g)the instrument is firmly installed in the position intended for use.
(2) When making an inspection of an area measuring instrument, an inspector shall ensure that it accords with the provisions of subregulation (1) and shall ensure that when a reference standard in the form of one or more templets, is passed consecutively through the measuring apparatus, evenly distributed—
  • (a)the area measuring instrument does not indicate in excess of the maximum permissible error for area measuring instruments on each occasion when the reference standard is passed through the instrument; and
  • (b)when the reference standard is passed through the instrument 20 consecutive times, the mean of all errors found, does not exceed one-half of the maximum permissible error for area measuring instruments.
