AN ACT TO ESTABLISH THE LAND TRANSPORT AUTHORITY, TO REGULATE THE REGISTRATION AND USE OF VEHICLES, THE LICENSING OF DRIVERS OF VEHICLES AND THE ENFORCEMENT OF TRAFFIC LAWS AND TO PROVIDE FOR THE REPEAL OF THE TRAFFIC ACT AND FOR RELATED MATTERS

(2) If 4 or more demerit points are awarded against a holder of a provisional licence during the period prescribed in the provisional licence, the holder of the provisional licence is to be disqualified from holding a driver's licence for 6 months.
(3) For the purpose of subsection (1) or (2), the period of disqualification commences—
- (a)in the case of a person convicted by the court, on the conviction date.

(5) If a person is liable to be disqualified under this section from obtaining or holding a driver's licence, the Authority shall, subject to subsection (6), serve on the person a notice (in this Act referred to as a “disqualification” notice) informing him or her that he or she is so disqualified for the period of 6 months.
(6) If a person is to be disqualified under this section from obtaining or holding a driver's licence, the person may, before being served with a disqualification notice, surrender his or her licence to a police officer or to the Authority and, the person becomes so disqualified from the date of surrender.
(7) The period of disqualification referred to in subsection (5) shall commence—
- (a)on the date of the serving on the person of that notice; or
- (b)where the person surrenders his or her licence to a police officer or to the Authority within the period referred to in paragraph (a), on the date on which the licence is surrendered.
(8) A disqualification notice may be served on a person—
- (a)by delivering it personally to the person;
- (b)by leaving it at the address of the person's place of residence last known to the Authority with someone who apparently resides there, being a person who has or apparently has attained the age of 16 years; or
- (c)by sending it by registered mail to the address of the person's place of residence last known to the Authority.
